TERMS AND CONDITIONS
1. Scope of Services
The business operates strictly as an independent consulting service. Services include facilitating laboratory analysis through preferred third-party ISO/IEC 17025 accredited testing laboratories, providing non-accredited result interpretations against relevant water quality standards using a compliance colour-coding system, and offering general guidance on small-scale home water treatment systems.
2. Third-Party Laboratory Testing
-
Outsourced Testing: All analytical testing is performed by independent, external laboratories holding ISO/IEC 17025 accreditation.
-
-
Separation of Entities: The business acts as an intermediary and consultant; it does not own, operate, or directly oversee the internal testing procedures, methodologies, or quality management systems of the selected third-party laboratories.
3. Courier Services and Sample Logistics
-
Independent Providers: Sample collection, transit, and delivery are executed entirely by independent third-party courier services.
-
No Direct Control: The business exercises no operational control over courier transit schedules, vehicle logistics, transit delays, or handling procedures.
-
Selection Criteria & Liability: Couriers are selected in good faith based on historic reliability. The business accepts no liability for compromised sample integrity, temperature excursions, sample loss, or delivery delays resulting from third-party courier operations.
4. Interpretations, Opinions, and Non-Accredited Scope
-
Consulting Opinions Only: All report write-ups, compliance colour-coding (identifying determinand compliance or non-compliance against selected standards), and narrative analyses constitute the professional opinions and interpretations of the consultant based on technical experience.
-
Exclusion from Accreditation: All advisory notes, interpretations, and treatment recommendations do not fall under any ISO/IEC 17025 scope of accreditation held by the testing laboratories.
-
Human Factor & Error Disclaimer: Analytical interpretations and advisory comments are inherently subject to human factors, potential oversight, and scientific limitations. While all reasonable care is taken, the business provides no express or implied warranty regarding the absolute accuracy or infallibility of advisory interpretations.
5. Home Treatment Recommendations and Client Responsibilities
-
Advisory Suggestions: Recommendations regarding small-scale domestic water treatment solutions (e.g., filtration, media systems, disinfection) are basic advisory suggestions intended solely for general guidance.
-
Client Maintenance Obligations: The effectiveness, safety, and longevity of any recommended treatment setup are strictly dependent on the client’s continuous monitoring, proper installation, and diligent maintenance (including regular filter replacements, media servicing, and routine operational checks).
-
Limitation of Liability for Systems: The business accepts no responsibility or liability for water quality failures, equipment damage, property loss, or health-related consequences arising from unmonitored, improperly installed, or poorly maintained domestic treatment hardware.
6. Cancellations, Returns, and Refunds
-
Pre-Dispatch Cancellation: Cancellation requests must be submitted in writing and received prior to the dispatch of sample collection kits. Once a kit has been dispatched, the order is locked into fulfillment and cannot be cancelled or refunded.
-
Laboratory Intake Cut-off: Once sample collection kits or samples are received by the testing laboratory, no cancellations, service modifications, or refunds will be processed under any circumstances.
-
Commencement of Analysis: All analytical and consulting fees are strictly non-refundable once sample processing or laboratory testing has commenced.
-
Consulting Deliverables: Due to the bespoke nature of data interpretation, colour-coded reporting, and advisory write-ups, digital deliverables are completely non-refundable once compiled or issued.
-
Transit Incidents: If samples are compromised or lost in transit by the independent courier, the business will assist in coordinating a replacement kit or re-collection where practical; however, direct financial refunds will not be issued for third-party courier disruptions.
7. Data Protection, POPIA, and Customer Confidentiality
-
POPIA Compliance: All personal information and analytical data are processed in strict compliance with the Protection of Personal Information Act (POPIA) and applicable privacy legislation. Personal data is collected solely for the purposes of facilitating laboratory testing, compiling interpretation reports, and billing.
-
Confidentiality: Client results, sample details, and consultative reports are treated with strict professional confidentiality and will not be disclosed, sold, or shared with unauthorized third parties.
-
Authorized Report Distribution: To safeguard customer confidentiality and data security, final test results, interpretation write-ups, and associated communication will only be sent to the email address(es) included in the original enquiry email chain. Reports will not be forwarded or disclosed to any outside third party without explicit, verifiable written authorization from the primary client.
8. Limitation of Liability
To the maximum extent permitted by law, the business shall not be liable for any direct, indirect, incidental, consequential, or special damages resulting from the use of test reports, reliance on consultative opinions, courier transit disruptions, third-party laboratory anomalies, or the ongoing operation of any recommended treatment hardware.
